Estimate potential OSHA fines based on violation type, company size, and compliance history. Updated with 2026 penalty amounts.
OSHA adjusts penalty amounts annually for inflation. These are the current maximums effective January 2026:
| Violation Type | Maximum Per Violation | Notes |
|---|---|---|
| Serious | $16,131 | Hazard that could cause death or serious harm |
| Other-Than-Serious | $16,131 | Directly related to safety but unlikely to cause death |
| Willful | $161,323 | Intentional or plainly indifferent violation (min $11,524) |
| Repeat | $161,323 | Same or similar violation within 5 years |
| Failure to Abate | $16,131/day | Per day beyond the abatement date |
| Posting Requirements | $16,131 | Failure to post citations or OSHA poster |
OSHA uses a gravity-based penalty system. The base penalty depends on the severity of the hazard and the probability that an injury will occur. Adjustments are then applied:
OSHA can cite violations on a per-instance basis when the same hazard affects multiple employees or locations. For example, if 10 workers lack fall protection, OSHA could issue 10 separate serious violations at up to $16,131 each ($161,310 total) rather than a single violation. Per-instance citations are more common for willful and egregious violations.
